Acceptance of Terms

By downloading, installing, or using the Fitnex application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms form a legally binding agreement between you and Fitnex ("we", "our", or "us"). Please read them carefully.

If mandatory consumer protection laws in your jurisdiction provide rights that conflict with these Terms, those mandatory rights will apply.

Eligibility

You must be at least 13 years old to use Fitnex. By using the App, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years old, you must have the consent of a parent or legal guardian to use the App and any paid features.

Your Account

To use Fitnex, you must create an account. You may be able to sign up using an email address and password, or through supported third-party sign-in providers (such as Google or Apple).

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at dev.saif17@gmail.com

If you sign in via a third-party provider, your use of that provider is governed by their own terms and privacy policy. We do not control third-party authentication services.

We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions & Billing

Fitnex offers a premium subscription plan called Fitnex Plus, which unlocks additional features including unlimited AI workout generation and an ad-free experience.

Billing

• Subscriptions are billed on a recurring basis (monthly or annually, as selected)
• Payment is charged through your app marketplace account (Apple App Store or Google Play) at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

Cancellation

• You may cancel your subscription at any time via your marketplace subscription settings (Apple ID or Google Play)
• Cancellation takes effect at the end of the current billing period — you retain access until then
• We do not offer refunds for partial billing periods, except as required by applicable law; refund requests are handled by Apple or Google under their policies

Price changes

• We may change subscription prices with reasonable notice
• For renewing subscriptions, pricing changes are applied through your marketplace in accordance with their policy and notice requirements

Free Tier & Ads

Fitnex is available for free with limited features. Free-tier users may see advertisements served by Google AdMob. These ads help keep the app free for everyone.

• Ads are served by Google AdMob and governed by Google's privacy and advertising policies
• Upgrading to Fitnex Plus removes all advertisements
• Free-tier users have a limited number of AI workout generations per day

AI Features

Fitnex includes an AI Workout Generator that creates personalized workout plans based on your inputs and profile data.

• AI-generated workouts are suggestions only and should not replace professional fitness advice
• The quality and accuracy of AI outputs depend on the information you provide
• We do not guarantee that AI-generated workouts are suitable for your specific health condition or fitness level
• Free-tier users are limited to a set number of AI generations per day; Fitnex Plus users have unlimited access

Acceptable Use

You agree not to use Fitnex to:

• Violate any applicable local, national, or international laws or regulations
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use automated scripts or bots to interact with the App
• Interfere with or disrupt the App's servers or networks
• Create multiple accounts to circumvent usage limits or restrictions
• Use the App in any way that could damage, disable, or impair the service

Privacy Policy

Your use of Fitnex is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal data.

By using Fitnex, you acknowledge and agree to the data practices described in the Privacy Policy.

Intellectual Property

All content in Fitnex — including the App design, code, graphics, logos, and AI-generated workout templates — is owned by or licensed to Fitnex and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from any part of the App without our written permission.

Your workout data and personal content remains yours. You grant us a limited licence to use it solely to provide and improve the Fitnex service.

Health Disclaimers

Fitnex is a fitness tracking tool and is not a medical application. The content and features of Fitnex, including AI-generated workout plans, are for informational and general fitness purposes only.

• Fitnex does not provide medical advice, diagnosis, or treatment
• Always consult your doctor before beginning any new exercise program
• Stop exercising immediately and seek medical attention if you experience pain, dizziness, or shortness of breath
• You use the App and follow workout recommendations at your own risk

Limitation of Liability

Fitnex is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Fitnex and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Physical injury resulting from following workout recommendations
• Loss of data or unauthorized access to your account
• Interruptions in service or App unavailability
• Any reliance on AI-generated content

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim, except where a higher amount is required by applicable law.

Termination

You may stop using Fitnex and delete your account at any time. Account deletion can be initiated from within the App settings or by contacting us at dev.saif17@gmail.com.

We reserve the right to suspend or terminate your account without notice if you breach these Terms or if we reasonably believe your use of the App poses a risk to other users or the service.

Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will remain in effect.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or by email. The updated Terms will be posted on this page with a revised effective date.

Your continued use of Fitnex after changes are posted constitutes your acceptance of the new Terms.

Third-Party Services

Fitnex relies on third-party services to operate core features. Your use of Fitnex may also be subject to those services' terms and policies.

• Firebase (Google): authentication, cloud database, and backend functions
• Google AdMob: ad delivery for free-tier users
• Google Generative AI (Gemini): AI workout generation processed through our backend
• RevenueCat + Apple/Google billing systems: subscription status and in-app purchase management

We are not responsible for outages, errors, or policy changes made by third-party providers.

Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles.

If you are a consumer, mandatory laws in your country or state of residence may give you additional rights that cannot be waived by contract.

Dispute Resolution

If you have a dispute with us, you agree to first contact us at dev.saif17@gmail.com and attempt an informal resolution.

If we cannot resolve the dispute informally, disputes will be resolved by the courts of competent jurisdiction, unless applicable law requires a different forum.

Nothing in this section limits either party's right to seek injunctive or equitable relief where legally permitted.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Fitnex and its affiliates, officers, agents, and service providers harmless from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from:

• Your misuse of the App
• Your violation of these Terms
• Your violation of applicable law or third-party rights

General Provisions

• Entire agreement: These Terms and the Privacy Policy form the entire agreement between you and Fitnex regarding the App.
• Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in effect.
• No waiver: Failure to enforce any provision is not a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or asset transfer.
• Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control.

App Store Terms

If you downloaded Fitnex from the Apple App Store, you acknowledge that these Terms are between you and Fitnex, not Apple. Apple has no obligation to provide maintenance or support for the App and is a third-party beneficiary of these Terms solely as required by Apple's standard terms.

If you downloaded Fitnex from Google Play, your use of the App is also subject to Google Play terms and policies. Nothing in this section limits any non-waivable consumer rights you may have under applicable law.
